Default Aptera (assignment for the benefit of creditors), LLC

I received some interesting mail today, basically saying that creditors of Aptera must file a claim before June 4, 2012.

I suppose I am a "creditor" in the sense that I paid a $500 vehicle deposit and have not received a refund.

Hmm, interesting.

The forum won't let me attach anything over 40 kb, so for now, scans are posted here: letter, claim form

I want to let you know two things. 1.) Could Paul Wilbur be sued Aptera Depositors in a Court of Law for lying to Aptera Depositors about their $500 Deposits being hed safely in a Wells Fargo Bank Account in case of this exact same event call bankruptcy? The big question is where did over (5,000 Aptera Depositors times $500 each =) $2.5 Million Dollars USD of Aptera Depositors money go? 2.) In 2009, when General Motors was going through Chapter 11 bankruptcy, they were required by SEC Law to send paperwork letting investors, Depositors and Etc. know that General Motors was bankrupty, what your rights as a shareholder was, and how did you want to vote on certain issues. Aptera Motors Inc. did not send the bankruptcy paperwork to investors, Depositors and Etc. as required by SEC Law. Aptera Motors Inc. made Aptera Motors Inc. Investors, Depositors and Etc. get the paperwork themselves. I think Aptera Motors Inc. must have some how lost all of the contact information of the Aptera Motors Inc. Investors, Depositors and Etc. Is it possible that the contact information of the Aptera Motors Inc. Investors, Depositors and Etc. was stolen or destory by someone when Aptera Motors Inc. Bankruptcy.

Many people got there money back a long time ago. Many people were warned this was going to happen and they decided to ride it out to the end. Others never came here and never bothered to check in on the delays and decide to get refunded. There should be no shock to anyone that has been coming here often. I also doubt there were many deposits left six months ago. I think there was plenty of warning here and elsewhere as to getting one's deposit back with time to spare unless you simply got all your information from the Dark Star exclusively and believed the hype from the MM BS grinder. I hope people look up PW in the phone book and give him a call to help them get their money back. Perhaps call him at his next job, I'm sure all his buddies will be there as well.

Evmavin...I am sure everyone, me included, feel bad enough. It isn't our fault we don't have our refunds. We are working deligently to get them back. We also know there is a chance we won't, of course. Berating us doesn't help.

I got the same claim form in the mail today as well. The hard part is all the gobble-de-kook and legaleeze BS. Hard to tell whicih part is to be filled out by us (creditors), but I am going to do my best and drop that sucker in the mail tomorrow.

I'm not berating anyone I can assure you. Except for PW, if that is even possible. Everyone deserves a refund and if it were my money I would sue him even in small claims court if only to tell him how I felt. This is not some large corporation it was a small start up where PW made small business promises but ran the place like it was some giant multinational. As a long time business owner I would never allow something like this to happen to deposit holders and I would have ensured this was resolved before all else. This defines who he is as a person. This is why he failed, why the talent left, and why he will fail for the rest of his life. When they say people are not corporations, they were wrong because he is a perfect example of one and everything wrong with businesses today. Unfortunately he got involved with a company that modeled what businesses should be like today and he contaminated it with his team of parasites. Had Aptera failed with Team A "types" it would have been very unfortunate, because of PW and others it was killed off. The sad part is I would not doubt that some of these people think they did everything right and some could care less about the deposit holders. That was a bit clear when the started publishing news letters. Best of luck to all and be diligent.

Truthseeker. Again, I like your enthusiasm for all things Aptera, but filing a lawsuit at this point is jumping the gun. The form Dolphyn and others have received is an attempt to find those that are owed money, confirm they are owed money so they can be paid back out of the proceeds of the liquidation. If the liquidation is completed and they are still stiffed then a lawsuit would be appropriate.
