Does anyone know the name of the liquidation company to see if they might be able to point us in the right direction? I'd be happy to give them a call.

For whatever it's worth, I spoke to Wells Fargo before the account was closed and they weren't able to help then either, though they were sympathetic. Another Aptera deposit holder had called them earlier in the day. The WF person (she was nice) said they had the account, but weren't authorized to release funds; only Aptera could do that. In any case, given the account is closed now, that doesn't help us with the current situation, just thought some might be interested.

Thank you.

Your name has been added. Some of use were called by Aptera letting us know refunds were imminent. This tells me that they must have had good intentions, but along the way............ <sigh>

I feel bad for people in this situation but any person that came to this forum once a month had plenty of advance warning and everyone was advised to get their money long before Sept. If you don't get your money you know who you can ultimately thank. But of course he will blame it on someone else, that's why others do his dirty work and he kept Laura hidden away.

Hi evmavin
I wish I had found or heard of this forum a long time ago....but I didn't and so here I am. Dang

I haven't received a refund (reservation #27, Sept 2007) but today's mail included a letter and claim form from "Aptera (assignment for the benefit of creditors), LLC."

This seemed worthy of a new thread, which I have posted here: http://apteraforum.com/showthread.php?t=4920

Sorry to hear that. I hope everyone gets their money back. PW is once again giving EVs a bad name, something he seems good at, bad PR.

I am curious how the money was lost. Steve has mentioned that when he and Chris set up the account they went out of their way to prevent this situation from happening. Just a guess, but given the extended time the money sat in the account perhaps the bank contacted an Aptera Rep (Laura Marion?) and forced them to take the money out of the account. This then opened the funds up to being misplaced or pilfered. The good thing is it doesn't seem like a large amount - say 50 depositors left out in the cold.

At this point it's all guesswork...

Good luck on getting your money back. My guess is that the money from the liquidation will be used to pay you back.

I think there are quite a few more than 50 of us out here. I just stumbled across this thread today. When I heard the news in December I was expecting to receive a letter or something re: my deposit. Instead, today I received a the Notice of Assignment. My bet is that there are a couple hundred folks who don't know the details yet and will be learning them today.

And since that "Notice" found me easy enough, I'm sure Wells Fargo could have if they tried.

My understanding is the escrowed money could not have been just turned over to Aptera - much the same way escrowed money in a home sale just cannot just be turned over to the seller. It can only be returned to the buyer, unless the terms of the escrow must be met. Same thing with the escrow account for your mortgage. That money can only be used to cover taxes / insurance or it must be returned to you. It can't be withheld to cover late fees or missed payments.

So ... someone has the money and my bet is they are simply dragging their feet in giving it back since every day they have it they can make more money on it.

Is your letter the same one Dolphyn and others have received? A link is provided by him on this thread:

http://www.apteraforum.com/showthread.php?t=4920

Again, good luck.

I have never received a letter. Though I did read up about it on here earlier

today. I left a message for Alex Van Dillon, (858)762-4066. The Idealab

operator gave me this # today.

Reserved in 2008
Original reservation # 1780
new # 980

Default is there any tax writeoff for lost deposits?

I'm wondering if anyone knows if we can claim a loss on taxes on the $500 deposit, which I assume will never be refunded. We don't even have a "receipt". Live n learn, so many dreams smashed with those protos.

Um, you should have an email that says you reserved an Aptera, the reservation amount paid, along with the reservation number assigned to you. That should do it.
